Terms and conditions for withdrawal, return, refund, and claim

1. Right of withdrawal

1.1 After the client has received the ordered products, he may, during a cooling-off period of thirty (30) days after receipt of the products, cancel the underlying agreement with Medicadermis B.V. , revoke without giving reasons.

1.2 This period commences on the day on which the consumer or a third party designated by the consumer, who is not the carrier, physically takes possession of the goods, or:

1.2.1 if the consumer has ordered multiple goods in the same order that are delivered separately, the day on which the consumer or a third party designated by the consumer, who is not the carrier, physically takes possession of the last good;

1.2.2 if the delivery of a good consists of several shipments or parts, the day on which the consumer or a third party designated by the consumer, who is not the carrier, physically takes possession of the last shipment or the last part;

1.2.3 for agreements concerning a subscription to goods for a specific period, the day on which the consumer or a third party designated by the consumer, who is not the carrier, physically takes possession of the first good.

1.3 If the client exercises his right of withdrawal, he shall notify Medicadermis in writing within the cooling-off period by means of the model withdrawal form or in another unambiguous manner. B.V. .

1.3.2 To exercise the right of withdrawal, it is sufficient to send notification of the exercise thereof within the period referred to in Article 1.1.

1.4 During the cooling-off period, the client shall handle the product and packaging with care. The principle here is that the client may only handle and inspect the product as they would be allowed to do in a store. A skincare product, skin treatment product, or (dermatological) make-up may not be used as a tester. If their contents are used, this category of products will no longer be saleable by Medikadermis. B.V. and therefore worthless.

1.5 The client is liable for any decrease in the value of the product resulting from handling the product in a manner that goes beyond what is permitted in the previous paragraph. The decrease in value will be deducted from the refund amount received by the client. Medicadermis B.V. is not obliged to return products for which the client has lost the right to a refund.

1.6 The client must return the products as soon as possible, but within thirty (30) days from the day of withdrawal. The client must return the products to a Medikadermis B.V. established return address or at the Medikadermis Huidtherapeutische Praktijk.Without prejudice to the right of withdrawal, you must return the product in the original packaging as much as possible and damage this packaging as little as possible. The risk and burden of proof for the proper and timely exercise of the right of withdrawal lies with the client.

1.7 Medicadermis B.V. bears the costs of returning the products if the client uses the return form and drops off the package at a PostNL Point. If the client wishes to return the products in another way, the costs are for the client and he bears full responsibility.

2. Obligations of Medicadermis B.V. upon revocation

2.1 As Medicadermis B.V. if it enables the client to submit a notice of withdrawal electronically, it shall send back an electronic acknowledgment of receipt without delay upon receipt of this notice.

2.2 Medicadermis B.V. reimburses all payments from the client, including any delivery costs by Medicadermis B.V. charged for the returned product, without delay but within thirty (30) days following the day on which the client notified Medicadermis of the withdrawal B.V. reports. Unless the client delivers the product to the Medicadermis Huidtherapeutische Praktijk themselves, reimbursement may be withheld until Medicadermis B.V. has received the product. Or until the client irrefutably demonstrates that the product has been returned and by Medicadermis B.V. is received, whichever time comes first.

2.3 Medicadermis B.V. Use the same payment method for the refund that the client used. The refund is free of charge for the client. Naturally, an item can also be returned if you paid with a gift card. You will receive the refund in the form of a digital gift card. If you used multiple payment methods (for example, iDeal or credit card), you will receive a digital gift card first. You will receive the remainder of the amount via the chosen payment method. This also applies if you only wish to return part of your order. The digital gift card will be sent to the email address you originally provided. The amount of this PDF voucher can be redeemed in full or in installments.

2.4 If the client has chosen and paid for a more expensive shipping method than the cheapest standard delivery, Medicadermis is not obliged to B.V. not to refund the additional costs for the more expensive method.

2.5 Medicadermis B.V. reserves the right to reimburse only the residual value of the returned products if the products have been damaged or otherwise depreciated at the client's risk or due to their fault.

2.6 Medicadermis B.V. may exclude the following products from the right of withdrawal: Sealed and/or unopened products that are not suitable for return for reasons of health protection or hygiene and/or whose seal has been broken after delivery.

2.7 When using a coupon discount, a minimum net spending amount may apply. In the event of a return, the net spending amount remains applicable. Should the return of a product or products cause you to fall below this minimum net spending amount, the full coupon discount will be offset against the return.

3. Advertising and warranties

3.1 The Client is obliged to examine, upon delivery, whether the products conform to the Agreement.If this is not the case, the client must Medicadermis B.V. to notify us of this as soon as possible, but in any case within thirty (30) working days after delivery, or at least after detection was reasonably possible, in writing and with reasons. Failure to do so will result in the forfeiture of any claim in this regard.

3.2 Product images do not necessarily correspond to the appearance of the delivered products. In particular, changes in the appearance and packaging of the products may occur following assortment updates by the manufacturer. The client cannot lodge complaints regarding observed defects if they concern these non-essential changes to the product.

3.3 If the delivered products are defective and do not conform to the Agreement, the Client shall be provided with a replacement product or with a remedy for the defect within a reasonable period. In the event of replacement, these General Terms and Conditions shall apply in full to this new delivery. If the remedy demanded by the Client is impossible or the costs thereof would be disproportionate for Medikadermis B.V. , has Medicadermis B.V. the right to refuse this remedy. The costs for the remedy are borne by Medicadermis B.V. worn. If repair or replacement is not possible or the costs thereof would be disproportionate, the client has the right to opt for rescinding the purchase and to receive a refund of the invoice value thereof. In this case, the use the consumer has made of the goods in the meantime may be charged.

3.4 Furthermore, any claim by the client regarding delivered products shall lapse if:

3.4.1 the products can no longer be identified as originating from Medicadermis B.V. ;

3.4.2 the defects are (partly) the result of normal wear and tear, improper or incorrect use by the client, incorrect handling and/or storage or maintenance of the products;

3.4.3 Medicadermis B.V. has not been immediately given the opportunity by the client to investigate the complaints and fulfill its obligations;

3.4.4 the client has failed to comply with any obligation incumbent upon him, or has done so late or improperly.

3.5 Complaints about defects shall in any event be time-barred two (2) years after the time of delivery of products.

3.6 The costs for returning products in the event of detected defects shall be borne by Medicadermis. B.V. .

4. Changes, version and application

4.1 These General Terms and Conditions apply from 1 October 2023, with document reference MD-HV-v1.01. The versions are numbered sequentially in the event of a change.

4.2 Medicadermis B.V. reserves the right to modify these terms and conditions at any time.
